Kansas Advance Directive Form (Medical POA + Living Will)

A Kansas advance directive is a set of instructions that helps a person’s medical providers, friends and family carry out their wishes when they are unable to communicate. The patient, referred to in these documents as the principal, may include special preferences for end-of-life care and may assign a power of attorney for healthcare who may make arrangements while the principal is unable.

State Definitions

  • Advance Health Care Directive (§ 65-3240(1)) – “Advance health-care directive” means a power of attorney for health care or a record signed by a prospective donor containing the prospective donor’s direction concerning a health-care decision for the prospective donor.
  • Declaration (§ 65-3240(2)) – “Declaration” means a record signed by a prospective donor specifying the circumstances under which a life support system may be withheld or withdrawn from the prospective donor.
  • Durable Power of Attorney for Health Care (§ 58-625) – A durable power of attorney for health care decisions is a power of attorney by which a principal designates another as the principal’s agent in writing and the writing contains the words “this power of attorney for health care decisions shall not be affected by subsequent disability or incapacity of the principal” or “this power of attorney for health care decisions shall become effective upon the disability or incapacity of the principal,” or similar words showing the intent of the principal that the authority conferred shall be exercisable notwithstanding the principal’s subsequent disability or incapacity.
