New Mexico Advance Directive Form (Medical POA + Living Will)

A New Mexico advance directive assigns a healthcare power of attorney to carry out an individual’s medical decisions if they become clinically unable to do so themselves. It also encompasses a living will, which allows the patient to document end-of-life wishes and comfort measures for the purpose of guiding medical staff and providing a record of their intentions.

Signing Requirements (NM Stat § 24-7A-2(B)) – Principal only.

State Definition (NM Stat § 24-7A-1(A)) – “Advance health-care directive” means an individual instruction or a power of attorney for health care made, in either case, while the individual has capacity.
